Which businesses cannot advertise on ChatGPT, and what should they do?
Under OpenAI's ad policies of September 2026, health services, financial services and legal services are generally prohibited outside the US and approved only case by case, with proof of licensure, inside it. Alcohol, tobacco, gambling, political content, dating and wellness products that make health claims are prohibited in every market. For a cosmetic clinic, dental practice, physiotherapy centre, insurance broker, lender or law firm outside the US, the ad door is closed under the current policy, and inside the US it opens one application at a time.
For those businesses, organic visibility is the only route into ChatGPT, and that is not bad news. When a user asks for "an orthodontist in Leeds who treats adults", the answer is built from sites that meet that question in plain sentences, and the ad ban means competitors cannot buy the shortcut either. Wellness sits on the line. OpenAI says fitness equipment, general nutrition products and supplements sold through major retailers may pass when they make no medical claims, while detox programmes, diet pills and health coaching do not. The real strength of the ad is that the user states their intent in their own words. Someone who types "balcony furniture" into Google tells ChatGPT "I want lightweight, folding, rain-resistant furniture for a small balcony, delivered within two days". The limits are just as clear. When the budget stops, the impressions stop. Paying subscribers are out of reach. On list questions such as "which is the best invoicing tool for a sole trader", the ad cannot enter the list inside the answer; it only adds a box beneath it. When does organic visibility come first?
Organic visibility aims to put your name inside the answer to "best", "near me", "which should I buy" and "who does this" questions, and it comes first in four situations: in prohibited categories, when you need to reach paying subscribers, when there is no continuous budget, and when you want something that lasts. Semrush's study of 126 million prompts found that 62% of AI citations produce no brand mention; even when your page is read, being named is separate work.
That work has three layers. On the site: pages that name the business in every important sentence, state the conditions (area, hours, who it is for, how fast) plainly, and carry an FAQ. Off the site: reviews that mention the occasion and the neighbourhood, consistent name, address and phone, third-party lists. For a local business, organic has one more advantage over the ad: on "near me" questions assistants usually name about three businesses rather than ten, chosen from the Google Business Profile, reviews and site text. How does one page serve both channels?
OpenAI requires that an ad's landing page not block its OAI-AdsBot and OAI-SearchBot user agents. The first reads the page for the ad's relevance score; the second reads it for organic answers. So the landing page you build for the ad can and should be the same service or product page you build for organic visibility. The shared infrastructure has three parts: one list of customer questions, one page written in plain sentences, and one analytics setup separated by UTM parameters.
